User Agreement

This User Agreement ("Agreement") is a legal agreement between you and pin'd LLC, governing your use of the pin'd LLC mobile application and website (collectively referred to as the "Service"), provided by pin'd LLC ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by the terms and conditions of this Agreement. If you do not agree to these terms and conditions, you may not access or use the Service.

 

Scope of Agreement

This Agreement applies to all users of the Service, including but not limited to visitors, customers, and contributors of content. This Agreement governs your use of the Service and any related services offered by pin'd LLC.

 

Account Registration

In order to access certain features of the Service, you may be required to register for an account. When registering for an account, you agree to provide accurate, current, and complete information about yourself. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

 

Use of the Service

You agree to use the Service only for lawful purposes and in accordance with this Agreement. You agree not to:

 

• Violate any applicable laws or regulations.

• Infringe upon the rights of any third party.

• Use the Service in any manner that could interfere with, disrupt, or negatively affect the Service or the servers or networks connected to the Service.

• Use any data mining, robots, or similar data gathering or extraction methods.

• Attempt to gain unauthorized access to any portion of the Service or any other systems or networks connected to the Service.

 

Intellectual Property

The Service and its original content, features, and functionality are owned by pin'd LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You agree not to modify, reproduce, distribute, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Service, except as necessary for your own personal, non-commercial use.

 

Privacy

Your privacy is important to us. Our Privacy Policy governs the collection, use, and disclosure of your personal information by us. By using the Service, you consent to the collection, use, and disclosure of your personal information in accordance with our Privacy Policy.

 

Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. pin'd LLC disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. pin'd LLC does not warrant that the Service will be uninterrupted or error-free, that defects will be corrected, or that the Service is free of viruses or other harmful components.

 

Limitation of Liability

In no event shall pin'd LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

 

Indemnification

You agree to indemnify, defend, and hold harmless pin'd LLC and its officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of this Agreement or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the Service using your account.

 

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Florida, without regard to its conflict of law principles.

 

Changes to this Agreement

We reserve the right to modify or replace this Agreement at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
